OF SALE
1. Sale of Goods
1.1 Foxford Jewellery of Foxford, Mayo, Republic of
Ireland (referred to herein as “we”, “us”
and our shall supply the goods you order from this website
(“goods”).
1.2 These conditions apply to our sale of the goods
to you together with our terms
and conditions of use of the website.
2 Orders
2.1 After you submit an order to this website,
we shall send you an e-mail confirming that we have
received and accepted your order. No contract shall
come into existence until you receive our confirmation
email. We reserve the right to refuse any order for
whatever reason.
2.2 Please take care to ensure that any order you submit
to this website is accurate. If you wish to change your
order, please let us know as soon as possible. We will
try to facilitate any changes that you wish to make
to your order before the goods are despatched to your
delivery address. If you want to change your order after
we have despatched the goods, you will need to return
the goods to us and you will have to pay the delivery
charges.(Please see our Returns Policy at paragraph
8 below).
3 Specifications
3.1 The goods will be essentially the same
as the samples pictured and/or described on this website.
If the goods are not identical to those pictured and/or
described, any variations will only be slight. We have
made every effort to display the colours of the goods
as accurately as possible on this website. Please note,
however, that the colours you view will depend upon
your monitor, for which we cannot take responsibility.
4 Price of the Goods
4.1 The website quotes the total price of the
goods in US Dollars, including value added or sales
tax (where applicable), import/customs duties and the
price of transport to your delivery address.
4.2 Once your order is confirmed, we shall debit from
your credit card account the total price of the goods
as quoted in US Dollars. The price of the goods will
be converted into your local currency by your credit
card company. Please note that the amount debited from
your credit card will depend on the actual exchange
rates applied by your credit card company.
5. Terms of Payment
5.1 You shall pay us for the goods by submitting your
credit card account details and authorising us to debit
the total price of the goods from your credit card account.
5.2 If for some reason we do not receive full payment
for the goods we may cancel your order and suspend further
deliveries to you. Property in the goods shall only
pass to you once we have received full payment for the
goods.
5.3 Any personal information received by us will be
held in accordance with paragraph 9.1
6. Unavailability of Goods
6.1 In the event that the goods are unavailable,
we shall contact you to offer you alternative goods,
or agree to cancel your order.
7. Delivery
7.1 We shall deliver most goods to your delivery address
within 30 days of sending you confirmation of your order.
However, where goods are being customised or personalised,
such goods may by their nature take a longer period
to complete. Therefore, these goods may not be delivered
to you delivery address within 30 days but will be delivered
within 7 weeks of sending you confirmation of your order.
We may be able to deliver the goods to you in a shorter
period of time, depending on your location.
8. Returns Policy
8.1 Subject to clause 8.2 below, if you wish
to cancel your order for any reason, we will be happy
either to refund the price of the goods to you or exchange
the goods, but only if you notify us and return the
goods to us within 30 days of the date when you received
the goods.
8.2 You may only return or exchange goods if they are
new and unused and contained in their original packaging.
If the goods are worn or used or not returned in their
original packaging, we will not accept them for return
or exchange. In addition goods which we have customised
to your specification or which are clearly personalised
(including goods which have been engraved) may not be
returned or exchanged.
8.3 If you return the goods to us, please specify clearly
whether you would like a refund or whether you wish
to exchange the goods (e.g. for a different size or
colour where appropriate).
8.4 Returned goods must be sent to Foxford Jewellery,
Foxford, Mayo, Ireland.
8.5 If you return the goods for a refund, we will reimburse
the price of the goods in US Dollars to your credit
card account within 30 days of receiving the goods and
your notification that you wish to return the goods.
Your credit card company will convert the value of the
US Dollars into your local currency, using the exchange
rate at the date of reimbursement.
8.6 If you wish to exchange the goods, we will deliver
to you replacement goods of the same value which are
available for purchase from this website. Please note
that we shall deduct from your credit card account the
cost of delivering the replacement goods to you.
8.7 We will reimburse you for the cost of returning
the goods to us, only if the goods are damaged or faulty.
If you wish to return or exchange goods which are not
damaged or faulty, and we incur costs in recovering
these goods from you, we shall be entitled to charge
our recovery costs to your credit card account.
8.8 The returns policy set our above does not affect
you statutory rights. If you receive goods which you
believe are damaged or faulty, please contact us:

9 Privacy
9.1 We shall only use the personal information that
you submit to this website to process your order and
supply the goods to you. We shall not use your personal
information for other purposes. Personal information
retained by us will be retained in accordance with the
Irish Data Protection Acts 1988 and 2003. We do not
sell, trade or rent your personal information to others.
10 General
10.1 If any provision of these conditions is
held by any competent authority to be invalid or unenforceable
the provision in question shall be omitted and the other
provisions shall not be affected.
10.2 These conditions shall be governed by the laws
of the Republic of Ireland.
